This web page represents our Terms and Conditions ("Agreement") regarding our website, https://secalerts.co. It was last updated on 20 November 2020. The terms, "we", "us" and "our" as used in this Agreement refer to SecAlerts, a registered Pty Ltd company in Australia. SecAlerts grants you a non-exclusive, non-transferable, revocable license to access and use our Website. We reserve the right to update this Agreement from time to time at our sole discretion, without notice.

User information and Privacy

Users may create and sign up for an account with SecAlerts. User Information stored is: Email address and a list of software provided by the User. User information, content and associated data is private to all Users of SecAlerts.

We reserve the right to remove a User's account at any time for any reason with no required notice to the account owner. Users may choose to delete their account and associated data by unsubscribing from a link in every Email. This action will remove all User data.

User data remains private within SecAlerts and will never be shared, sold or distributed with a third party unless in a business transfer such as an acquisition or merger.

We reserve the right to use the provided User Information for targetted advertising. However, you will never receive contact from any entity other than SecAlerts.

Liability

Due to the nature of public vulnerabilities, SecAlerts can make no guarantee that every vulnerability publicly available will be discovered and alerted by SecAlerts. SecAlerts obtains vulnerability data from NVD and is dependent on any upstream issues or delays that may arise. Other reasons may prevent certain vulnerabilities from being sent such as malformed data, inconsistency in naming causing a mismatch or any other unforseen scenario. SecAlerts provides no service level agreement to the accuracy, comprehensiveness or timing of this data and when or if they are sent. It is the responsibility of the User to ensure they are aware of vulnerabilities from a variety of sources.

SecAlerts is an alert service using information and data from external and third-party sources including NVD, Bing News API and web scraping. We do not claim ownership, liability or responsibility for the data and content presented in the alerts. SecAlerts is a forwarding and notification service ONLY.

The use of the term "Instant" is purely a naming convention to distinguish from other plans and does not make the guarantee that alerts will be immediately sent by SecAlerts. Instant Alerts in the Business plan have a window time of ONE HOUR as opposed to the Free plan which has a window time of ONE WEEK. This is for the benefit of the User to prevent an overload of alerts. Alerting time refers to the time in which SecAlerts receives data from the external and third-party data providers and does NOT refer to when the data or information was made public. There may be delays that are upstream from our sources. There may be delays sending the alert via electronic mail due to our mailing provider, SendGrid. Purchasing the Business plan offers no service level agreement of the time you receive alerts.

The term "zero-day" typically means a vulnerability that is unknown to the public or vendor or without a patch. Zero-day alerts in SecAlerts means we look for the use of the term inside News articles as well as include the Zero Day Initiative advisory who often publishes zero-days that the vendor has not fixed. This means we cannot guarantee that it meets your criteria of a "zero-day" or that the alert was sent as soon as publicly available as we are reliant on the term to appear in cybersecurity news publications.

Affiliates

We offer 30% recurring commission for any users on the Business plan who created an account with your referral code. This code must be sent to SecAlerts along with PayPal information prior to any sign ups so we are able to correctly calculate payouts.

Payouts will be monthly at the end of each month. New accounts require a 40 day waiting period in case of card chargebacks. In the event of a chargeback, refund or cancellation within the first month, no commission will be awarded.

We may offer a higher commission for partners who consistently perform or can prove the value of a higher percentage so please contact us beforehand to settle on an agreed rate.

Refunds

SecAlerts offers full refunds at any point and for any reason within 2 weeks of the purchased time or at any time with valid reasons.

Plans

"Business" plan is a paid service of USD$49/month. The plan lasts until the User ends the service, at which time the User's details will be deleted and they will no longer receive vulnerability alerts. Users can cancel the service at any time. The plan is charged on a monthly basis and Users will forfeit the remainder of that months cost of the plan when they cancel. Support queries for our Business plan are to be made via our support email address (info@secalerts.co).

If a User of our Trial service has been offered any special offers related to our Business plan, this rate will revert to the full amount of USD$49/month at the end of the offer.

"Trial" service allows Users all the features of our "Business" plan and lasts 14 days from the time the User signs up. At the end of 14 days, the User's service will be made inactive if they do not upgrade to our Business plan and they will no longer receive vulnerability alerts. Users can unsubscrube at any time before the end of 14 days. Users will receive notifications that the Trial service will be ending and can submit payment details (upgrade to our Business plan) at any time during the Trial service.

General

You are free to distribute, reuse, promote or display our branding material (logo, name, tagline).

We value user feedback. If you choose to submit comments, ideas or suggestions you permit us free access to implement with no restriction or compensation.

This Agreement shall be governed and construed in all respects by the laws of Brisbane, Australia. You agree that any claim or dispute you may have against SecAlerts must be resolved by the courts of Brisbane, Australia. It is the liability of you, the User, to ensure your use of this service complies with your local laws.

OUR WEBSITE IS OPERATED BY SecAlerts ON AN "AS IS," "AS AVAILABLE" BASIS, WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND. SecAlerts DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED. YOUR USE OF OUR WEBSITE AND ANY CONTRACTS OR SERVICES ARE AT YOUR OWN SOLE RISK. WE DO NOT HAVE ANY LIABILITY OR RESPONSIBILITY FOR ANY ERRORS OR OMISSIONS IN THE CONTENT OF OUR WEBSITE, FOR CONTRACTS OR SERVICES SOLD THROUGH OUR WEBSITE, FOR YOUR ACTION OR INACTION IN CONNECTION WITH OUR WEBSITE OR FOR ANY DAMAGE TO YOUR COMPUTER OR DATA OR ANY OTHER DAMAGE YOU MAY INCUR WITH OUR WEBSITE OR SERVICE. IN NO EVENT SHALL EITHER SecAlerts OR THEIR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF OUR WEBSITE, CONTRACTS AND SERVICES PURCHASED THROUGH OUR WEBSITE, THE DELAY OR INABILITY TO USE OUR WEBSITE OR OTHERWISE ARISING IN CONNECTION WITH OUR WEBSITE, CONTRACTS OR RELATED SERVICES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE.

This Agreement was originally written in English. We may translate the Terms into other languages. In the event of a conflict between a translated version of this Agreement and the English version, the English version will control.
